PLEASE READ THE FOLLOWING PRIVACY POLICY, FOR INFORMATION REGARDING THE WAYS YOUR PERSONAL INFORMATION MAY BE PROCESSED, CAREFULLY. WHEN YOU USE THE APP YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
There are several categories of information that can be processed.
We ask for and process the following information when you use the App. This information is necessary for the adequate performance of the contract between you and us. Without such information it is impossible to provide complete functionality of the App and perform the requested services.
Account Information (e.g. your e-mail address, or the account identifier provided by a third-party sign-in service you choose to use). We use this information to create and maintain your account, to keep your learning progress and subscription status in sync across your devices and between our mobile App and our website, and to restore your purchases.
User Content (i. e. the text and voice messages you send to the App, including your conversations with the AI tutor and your answers in lessons, exercises and the placement test, as well as any text, audio or other content generated by AI via the App, such as the AI tutor's replies, corrections and feedback). Subject to your compliance with certain rules and restrictions outlined in our Terms of Service, you may use User Content for your own personal learning purposes. However, any use of User Content is at your sole risk, i. e. you assume and bear all risks and responsibility associated with your use of User Content. It is your sole responsibility to ensure compliance with the applicable laws while using the User Content. Please note that we engage third-party AI model providers, including OpenAI, L.L.C., for the purpose of processing and generating AI-generated User Content. We also engage third-party speech recognition (speech-to-text) and speech synthesis (text-to-speech) service providers to transcribe your voice messages and to produce the AI tutor's voice. Please check Section IV to learn more about our service providers.
Learning Profile Information (e.g. your native language, learning goals, interests, self-assessed English level, placement test results, lesson history and learning progress). We use this information to assign lessons of a suitable difficulty level, to generate personalized learning content and to allow the AI tutor to remember relevant context from your previous sessions, so that your learning experience is continuous and tailored to you. For this purpose, the AI tutor may retain information you choose to share during your conversations (for example, your job or hobbies). Please do not share sensitive personal information (such as health, financial or identification data) in your conversations with the AI tutor.
Your conversation history and learning records are stored in your account so that you can review your past lessons within the App. However, we cannot guarantee that all historical User Content will remain accessible within the App indefinitely.
To learn more about the storage terms applicable to User Content, please review Section V of the present Privacy policy.
Processing of third parties' information. When using the App, you might share with us information relating to other persons (for example, by mentioning them in your conversations with the AI tutor), or your voice recordings may capture the voices of other people around you. In this case, you warrant that you have all necessary rights and authorizations to lawfully process such information and to share it with us and you acknowledge that you will be held responsible for the lawfulness of such data processing activity. You agree to fully indemnify us against any objection, claim, request for compensation for damage arising from such processing that we may receive from third parties whose information has been processed through your spontaneous submission in violation of the applicable laws. In any event, should you provide us with or otherwise process information of third parties, you warrant that this processing is based on an appropriate legal basis.
In order to talk with the AI tutor and practice speaking, the App needs access to your microphone. This access will require that you grant a specific permission through a request that will appear on your device. You can revoke this permission at any time in your device settings; however, speaking-related features of the App will not be available without it.
Contact Information (name, e-mail address, as well as any other content included in the email) which you may fill in by yourself when you contact us via email, support form. We collect, store and process it by our cloud storage provider (Amazon.com, Inc.). We use such information to respond effectively to your inquiry, fulfill your requests, send you communications that you request and perform the requested services.
What We Collect: When you use the speaking features of the App, such as conversations with the AI tutor, speaking exercises or the speaking part of the placement test, the App records your voice through your device's microphone. Your recordings are converted into text and may be analyzed for pronunciation, fluency, grammar and vocabulary in order to provide you with learning feedback. We do not create voiceprints, and we do not use your voice data to identify or authenticate you.
Feedback and assessment results (such as your estimated English level or pronunciation feedback) are generated automatically by AI and are provided solely for learning purposes. They may not always be accurate and do not constitute an official certification of your language skills.
How We Use Your Voice Data: Voice recordings and their transcripts are processed exclusively to provide the learning features of the App, including real-time conversation with the AI tutor, speaking feedback, lesson personalization and progress tracking, and to maintain and improve the quality of these features. We do not use your voice data for advertising purposes. We do not sell your data.
Storage and Retention: Transcripts of your conversations are stored on our secure servers hosted by Amazon Web Services (AWS) as part of your conversation history and are retained as described in Section V. Audio recordings are processed to deliver the requested features and are not retained longer than necessary for that purpose.
Third-Party Processing: To provide speech recognition, speech synthesis and AI tutoring, your voice recordings and conversation text may be transmitted to trusted third-party AI and speech technology providers, including but not limited to OpenAI. These providers process the data only to deliver the requested functionality. For more information about our service providers, please refer to Section IV: Sharing of Your Information.
Our e-commerce providers are responsible for billing, processing and charging for purchases. Purchases made within the mobile App are processed by the Apple App Store or Google Play. Purchases made on our website are processed by our online reseller Paddle.com, which acts as the Merchant of Record. We cannot access or use your credit or debit card information. We only receive limited transaction information (such as order number, subscription plan and status, country and the e-mail address used for the purchase) in order to activate and manage your subscription in the App.
You may access the applicable purchase rules and policies directly from the respective e-commerce provider.

When you use our App, analytics tools automatically record in-App information (onboarding steps, placement test completion, lessons started and completed, speaking practice sessions, learning progression events, payments, in-app purchases and subscription events, custom events, method of limiting the processing of user data).
Information provided automatically to advertising or analytics tools does not generally come to our control, therefore we cannot be responsible for processing such information. We do not control, supervise or stand surety for how the third parties process your personal data, that might be collected by their own means (not through our App). Any information request regarding the disclosure of your personal information should be directed to such third parties (see Section IV).
Our website and App use cookies and similar technologies, such as software development kits (SDKs), pixels, device identifiers and local storage (together, "Cookies"). Cookies are small pieces of data stored on or read from your device.
